Doctors Reject Mensalão Man’s Retirement Request

José Genoino, Workers’ Party (PT) Congressman for the state of São Paulo, and one of the men convicted on corruption charges in the mensalão case, has had a request denied by Congress for his immediate retirement.

Genoino made the request alleging poor health; however, a report by a team of doctors from Congress affirms that he is not suffering from any serious heart condition.

Next week a process is due to begin in Congress aimed at stripping Genoino of his political powers – and therefore his right to retirement benefit. His request is an attempt to block this move.

According to a report written by four cardiologists, Genoino cannot be considered definitively unable to work. However, the doctors recommend that he rest for a period of 90 days, after which he will be reexamined. They also indicate that the analysis of his case may last up to two years, if there are future requests that his health be reevaluated.

The doctors have based their report on tests that Genoino underwent recently in the Cardiology Institute in Brasília, after being admitted with dangerously high blood pressure. Genoino also had a medical exam on Monday.

The PT will do its utmost to block Genoino’s disempowerment; however, on Thursday Congress is due to decree the end of secret voting in this type of case, something likely to considerably reduce Genoino’s chances. For Genoino to lose his status, at least 257 of the 513 members of Congress have to vote against him.

As a Congressman, Genoino receives a salary of US$ 11,500 per month. If his status is removed, he will receive a retirement payment calculated in relation to his years of public service (he entered Congress in 1983). This stands at nearly US$ 8600.

Genoino, 67, was given a sentence of six years and 11 months for his part in the mensalão scandal. This year he underwent surgery to correct his aorta. In September, he requested retirement, but a medical team ruled that he would have to undergo new exams in January.

However, following his conviction, Genoino filed a request for immediate retirement. He is currently living with relatives in Brasília, under a regime of provisional house arrest while the Supreme Court decides whether he will serve his sentence in a prison in the capital.
